Welcome to IDONCLOUD.
These Terms of Service (“Terms”) govern your access to and use of all products and services provided by IDON DIGITAL SOLUTIONS, UNIPESSOAL LDA, operating under the IDONCLOUD brand.
By creating an account, placing an order or using any of our services, you acknowledge that you have read, understood and agreed to be bound by these Terms.
If you do not agree with these Terms, you must not use our services.
1. Scope of Services
These Terms apply to all services provided by IDONCLOUD, including but not limited to:
- Dedicated Servers
- Virtual Private Servers (VPS)
- Cloud Services
- Colocation
- VPN Services
- Proxy Services
- IP Transit & Network Services
- Domain Registration
- SSL Certificates
- Email Hosting
- Managed Services
- Any future products or services offered through our platform.
2. Customer Account
Customers are responsible for maintaining accurate account information and protecting their login credentials.
Any activity performed using your account shall be considered your responsibility.
IDONCLOUD reserves the right to request identity verification where required by law or to prevent fraud.
3. Service Provision
All services are provided subject to technical availability.
While IDONCLOUD strives to maintain maximum uptime, uninterrupted service cannot be guaranteed due to maintenance, hardware failures, software issues, upstream network incidents or force majeure.
Where applicable, uptime commitments are defined separately in our Service Level Agreement (SLA).
4. Billing and Payments
Services are billed in advance unless otherwise agreed.
Invoices must be paid before the due date.
Failure to pay may result in:
- Suspension of services
- Service termination
- Permanent deletion of data after applicable retention periods
Recurring services renew automatically unless cancelled before the renewal date.
5. Suspension and Termination
IDONCLOUD reserves the right to suspend or terminate services where necessary to:
- Protect network integrity
- Prevent abuse
- Comply with legal obligations
- Enforce these Terms
Immediate suspension may occur where continued operation poses a security, legal or operational risk.
6. Customer Responsibilities
Customers remain solely responsible for:
- Their hosted content
- Software installed on their services
- Data security
- Backup management
- Compliance with applicable laws
Unless explicitly stated otherwise, customers are responsible for maintaining their own backups.
7. Intellectual Property
Customers retain ownership of all content hosted on IDONCLOUD services.
Nothing within these Terms transfers ownership of intellectual property between either party.
8. Limitation of Liability
To the maximum extent permitted by applicable law, IDONCLOUD shall not be liable for:
- Data loss
- Loss of revenue
- Business interruption
- Indirect or consequential damages
- Third-party service interruptions
The total liability of IDONCLOUD shall never exceed the amount paid for the affected service during the previous billing period.
9. Third-Party Services
Certain services may rely on third-party providers, software vendors, registries or network operators.
IDONCLOUD cannot be held responsible for outages, policy changes or failures originating from third-party providers.
10. Policy Documents
The following documents form an integral part of these Terms of Service:
- Privacy Policy
- Acceptable Use Policy (AUP)
- Domain Registration Agreement
- Refund Policy (where applicable)
- Service Level Agreement (SLA), where applicable
By using our services, you also agree to comply with these policies.
11. Changes to these Terms
IDONCLOUD may update these Terms from time to time.
Updated versions become effective immediately upon publication on our website unless otherwise stated.
Continued use of the services constitutes acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by the laws of Portugal.
Any disputes arising from these Terms shall be subject to the jurisdiction of the competent Portuguese courts, unless otherwise required by mandatory applicable law.
